SUMMARY:To Classify as Independent Contractor or Not to Classify? That Is the Question
DESCRIPTION:Sponsored by the AGC MA HR Committee\n\n\nIn recent years\, we've seen an uptick in enforcement as it relates to the classification and misclassification of individuals providing services to companies as independent contractors versus employees. This issue has arisen across industries especially those that historically rely on contractors to provide a variety of services. The U.S Department of Labor's final rule revising previous guidance on how to analyze such classifications under the federal Fair Labor Standards Act is now in effect. In this webinar\, we will address the federal standard as well as standards under a number of laws\, agency guidelines\, and enforcement initiatives. We will also review best practices that employers should consider as well as the serious risks that misclassification poses. We welcome questions from attendees and participation.\n\n\n\n\n\n\n\nPresented by Robinson + Cole\n\n\n\nAbby M. Warren\, Partner\n\nAbby M. Warren represents employers in labor and employment matters. She focuses her practice on counseling private sector employers\, including multinational corporations\, health care organizations\, educational institutions\, and manufacturers\, in all areas of employment law. Abby also defends employers in federal and state court and before administrative agencies. In addition to counseling and litigation\, she provides workplace training for clients and conducts workplace investigations. She is a member of our firm's Labor\, Employment\, Benefits\, Immigration + Tax group.\n\n\n\nJessica C. Pinto\, Associate\n\nJessica C. Pinto assists in the representation of employers in employment law and workplace human resource matters.\n\nJess served as a summer associate for Robinson+Cole\, where she conducted research\, observed hearings\, and drafted memoranda and pleadings.
